Terms of Use (EULA)

Effective Date: January 2025

Welcome to My Album, a photo and memory sharing platform designed to help you preserve, organize, and share your precious memories with friends and family. Please read these Terms of Use and End User License Agreement ("Terms") carefully before using the My Album app ("App"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

​

By accessing or using the App, you acknowledge and agree that you have no rights or privileges with respect to the App or its developer. The App is provided strictly on an "as-is" basis, and your use of the App is entirely at your own risk. If you do not agree with any part of these Terms, you must not use the App.

 

2. Description of Services

​

The App provides the following core features ("Services"):

  • Memory Creation: Upload, organize, and share photos and videos as memories

  • Photo Management: Upload photos from your device gallery to create and share memories

  • Memory Sharing: Share memories with selected friends and family members

  • Comments & Interactions: Comment on and interact with shared memories

  • User Profiles: Create and manage your profile with name, email, and profile photo

  • Search & Discovery: Search for friends and discover shared memories

  • Memory Folders: Organize memories into custom folders

  • Privacy Controls: Control who can see and interact with your memories

The developer makes no guarantees or promises regarding the functionality, availability, accuracy, or reliability of the Services. The App is provided as a platform for memory sharing and preservation, and the developer assumes no responsibility for any outcomes related to its use.

 

3. Registration and Authentication

3.1 Account Creation

You must register for our Services using either:

  • Google Sign-In: We retrieve your name, email address, and profile photo from your Google account

  • Apple Sign-In: We retrieve your name, email address, and profile photo from your Apple ID

​

3.2 Information Collection

By signing in, you consent to us collecting and storing:

  • Your name (as provided by your authentication provider)

  • Your email address

  • Your profile photo

  • Any additional information you choose to provide

​

Registration does not grant you any rights or privileges beyond those explicitly stated in these Terms.

​

4. Age Restrictions

You must be at least 18 years of age to register for and use our Services (or be of sufficient age in your country or region to register for and use our Services without parental consent). If you are not of sufficient age to have the authority to agree to our Terms in your country or region, your parent or guardian must agree to our Terms on your behalf. The developer is not responsible for any issues arising from underage use of the App.

 

5. License Grant

The developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App solely for your personal, non-commercial use in accordance with the terms of this EULA. This license does not grant you any ownership rights to the App.

 

6. Photo and Content Management

6.1 Photo Upload and Storage

  • Gallery Access: You can select photos from your device gallery to upload to the App

  • Server Storage: Only photos you actively upload to create memories are stored on our servers

  • Gallery Privacy: Your device gallery photos remain on your device and are not accessed, copied, or stored by the App unless you explicitly choose to upload them

  • Memory Creation: Photos are only uploaded when you create a memory and choose to share it

6.2 Content Rights and Ownership

By uploading content to the App (including photos, videos, text, comments, profile information, etc.), you:

  • Grant the developer and My Album a perpetual, irrevocable, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, display, and delete your content in connection with the operation of the App

  • Acknowledge that My Album has full rights to remove, modify, or delete any content uploaded to the platform for any reason, without notice or liability

  • Agree that you are solely responsible for ensuring that your content does not violate any laws or infringe on any third-party rights

  • Understand that the developer is not liable for any consequences resulting from the use, modification, or removal of user-generated content

  • Certify that you have the necessary rights to share the content and that it does not infringe on any intellectual property rights

 

By using the App, you expressly waive any claims against My Album related to content removal, modification, or use.

7. Zero Tolerance Policy for Objectionable Content and Abusive Behavior

​

My Album maintains a strict zero-tolerance policy for objectionable content and abusive users. The following behaviors and content types are strictly prohibited:

​

Prohibited Content and Behaviors:

  • Spam: Repetitive, unsolicited, or irrelevant content

  • Nudity or Sexual Activity: Sexually explicit content or nudity

  • Hate Speech or Symbols: Content promoting hatred, discrimination, or violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics

  • Violence or Dangerous Organizations: Content that promotes, glorifies, or depicts violence, terrorism, or dangerous organizations

  • Bullying or Harassment: Content intended to intimidate, threaten, or harass other users

  • False Information: Deliberately sharing misinformation or fake news

  • Scam or Fraud: Deceptive practices, phishing, or fraudulent schemes

  • Suicide or Self-Injury: Content promoting or glorifying self-harm or suicide

  • Sale of Illegal or Regulated Goods: Promoting the sale of illegal drugs, weapons, counterfeit goods, or other regulated items

  • Intellectual Property Violation: Unauthorized use of copyrighted material, trademarks, or other protected intellectual property

  • Eating Disorders: Content promoting unhealthy eating behaviors or eating disorders

  • Drugs: Content promoting illegal drug use or abuse of prescription medications

  • Any Other Objectionable Content: Content that violates community standards or is deemed inappropriate by the developer

8. Content Reporting and Immediate Action

​

When content is reported by any user:

  • Immediate Removal: The reported content is immediately and automatically removed from the feed and all public areas of the App

  • Review Process: The removed content is sent to our review team for assessment

  • Final Decision: Our review team will determine whether the content should be:

  • Permanently removed (if it violates these Terms)

  • Restored (if it does not violate these Terms)

  • No Appeal Guarantee: The developer reserves the right to make final decisions regarding content, and such decisions are binding

Users understand and agree that reported content will be hidden immediately, even before the review is complete, to maintain a safe community environment.

 

9. Account Suspension and Banning

​

Accounts may be suspended or permanently banned if a user is reported for any of the following violations:

  • Spam

  • Nudity or sexual activity

  • Hate speech or symbols

  • Violence or dangerous organizations

  • Bullying or harassment

  • False information

  • Scam or fraud

  • Suicide or self-injury

  • Sale of illegal or regulated goods

  • Intellectual property violation

  • Eating disorders

  • Drugs

  • Any other objectionable or abusive behavior

The developer reserves the right to:

  • Immediately suspend or ban accounts without prior notice

  • Permanently delete all content associated with banned accounts

  • Take action based on a single report or multiple reports

  • Make final decisions without providing detailed explanations

  • Refuse to reinstate banned accounts

​

You acknowledge that account termination may result in the loss of all your data, content, and connections within the App, and you agree to hold the developer harmless for any such loss.

​

10. Account Deletion and Data Removal

​

10.1 Account Deletion Process

When you delete your account:

  • All your uploaded photos, videos, and memories will be permanently deleted from our servers

  • All comments, interactions, and shared content will be removed

  • Your profile information will be completely erased

  • Data Recovery: Once deleted, your data cannot be recovered under any circumstances

10.2 Data Retention

  • We do not retain any of your personal data after account deletion

  • Deleted content is permanently removed from our systems

  • We are not responsible for any loss of data resulting from account deletion

​

11. Responsible Use of Features

​

11.1 Memory Creation and Sharing

You agree to use the memory creation and sharing features responsibly and only for lawful purposes. The developer does not pre-screen or continuously monitor content posted by users, but reserves the right to remove any content at any time.

​

11.2 Comments and Interactions

You agree to use commenting and interaction features respectfully. While private communications are generally not monitored, the developer reserves the right to investigate reported conversations and take appropriate action.

​

11.3 Search and Discovery

You agree not to use search functionality to harass, stalk, or collect information about users for malicious purposes.

​

12. Devices, Software, and Data

​

To use our Services, you must arrange for certain devices, software, and data connections that we do not provide. You agree to:

  • Download and install updates to our Services, either manually or automatically, as necessary

  • Maintain compatible devices and software

  • Be responsible for all carrier data plan, internet charges, and other fees and taxes associated with your use of our Services

 

The developer makes no promises regarding the compatibility of the App with your devices or software and is not liable for any issues that arise from your inability to use the App.

13. Intellectual Property Rights

​

All content, features, and functionality of the App, including but not limited to text, graphics, logos, icons, software, and design, are the exclusive property of the developer or its licensors. You have no rights to reproduce, modify, distribute, or create derivative works based on the App without the express written permission of the developer.

​

14. Restrictions on Use

​

You agree not to:

  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App

  • Rent, lease, lend, sell, redistribute, or sublicense the App

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations

  • Use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App

  • Attempt to gain unauthorized access to any portion of the App or any systems or networks connected to the App

  • Use automated systems (bots, scrapers) to access the App

  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity

15. Third-Party Services and Links

​

The App may contain links to third-party websites or services that are not owned or controlled by the developer. The developer has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that the developer shall not be responsible or liable for any damages or losses caused by or alleged to be caused by your use of any such third-party content or services.

16. Disclaimer of Warranties

​

THE APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OR GUARANTEES OF ANY KIND. THE DEVELOPER EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The developer does not warrant that:

  • The App will meet your specific requirements

  • The App will be uninterrupted, timely, secure, or error-free

  • The results that may be obtained from the use of the App will be accurate or reliable

  • Any errors in the App will be corrected

  • Your data will be secure or protected from unauthorized access

  • Content posted by users is accurate, appropriate, or lawful

17. Limitation of Liability

​

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OR ANY OF ITS AFFILIATES, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Damages for loss of profits, goodwill, use, data, or other intangible losses

  • Loss of content or data

  • Account suspension or termination

  • Unauthorized access to or alteration of your transmissions or data

  • Statements or conduct of any third party on the App

  • Content removal or moderation decisions

  • Any claims related to reported content

  • Any other matter relating to the App

YOU AGREE THAT YOUR USE OF THE APP IS ENTIRELY AT YOUR OWN RISK, AND YOU ASSUME FULL RESPONSIBILITY FOR ANY DAMAGE OR LOSS THAT RESULTS FROM YOUR USE OF THE APP.

The developer shall have no liability whatsoever for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access to the App or your account.

​

18. Indemnification

​

You agree to indemnify, defend, and hold harmless the developer, My Album, and its affiliates, employees, agents, licensors, and partners from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees and costs, arising out of or in any way connected with:

  • Your access to or use of the App

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Your content or any content posted through your account

  • Any claims arising from reports made against your content or account

  • Your interaction with other users

19. Updates and Modifications

The developer reserves the right to:

  • Modify or discontinue, temporarily or permanently, the App or any part thereof with or without notice

  • Modify these Terms at any time

  • Provide updates, enhancements, or modifications to the App, which may be automatically installed on your device

​

Your continued use of the App after any such changes constitutes your acceptance of the new Terms. The developer is not liable for any consequences that may result from modifications to the App or these Terms.

20. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and share your information. The developer makes no guarantees regarding the security of your data and is not liable for any breaches that may occur. By using the App, you consent to the collection and use of your information as described in our Privacy Policy.

21. Force Majeure

The developer shall not be liable for any failure to perform its obligations under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to acts of God, war, natural disasters, pandemics, internet service failures, or government actions.

 

22. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. All disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Gurgaon, India.

 

23. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

 

24. Entire Agreement

These Terms constitute the entire agreement between you and the developer regarding the use of the App and supersede all prior agreements and understandings, whether written or oral.

 

25. No Waiver

The failure of the developer to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

27. Acknowledgment and Agreement

​

BY INSTALLING, ACCESSING, OR USING MY ALBUM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF USE AND END USER LICENSE AGREEMENT.

YOU ACCEPT THAT:

  • You use the App entirely at your own risk

  • You have no rights, privileges, or guarantees from the developer

  • Content you post may be removed at any time

  • Your account may be suspended or banned for violations

  • My Album has full rights to all content uploaded to the platform

  • The developer has no liability for any damages arising from your use of the App

  • Reported content is immediately removed and subject to review

  • You agree to maintain a respectful and lawful presence on the platform

  • When you delete your account, all your data is permanently deleted and cannot be recovered

  • Only photos you actively upload are stored on our servers; your gallery photos remain private on your device
