DMCA Takedown Policy

Effective Date: 1 January 2025

ProTalkie respects the intellectual property rights of creators and complies with the Digital Millennium Copyright Act (DMCA) and global copyright laws. We respond to valid copyright infringement notices and take appropriate action, even though ProTalkie uses end-to-end encryption (E2EE) and we cannot access message content.

This DMCA Policy explains how copyright owners can submit removal requests and how users may file counter-notices.

 

1. Our Role as a Communications Platform

ProTalkie is an encrypted messaging service.


Because all messages and media are end-to-end encrypted:

  • We do not access user content

  • We cannot decrypt or view media files

  • We cannot proactively scan for copyrighted material

  • We can act only based on user-submitted evidence and reported metadata

We nevertheless comply with DMCA obligations by:

  • Processing valid copyright notices

  • Limiting or terminating accounts of repeat infringers

  • Removing infringing material if provided directly by the complainant

2. What We Can and Cannot Remove

Due to encryption:

✔ We CAN remove:

  • Copyrighted media that you provide to us directly (e.g., screenshots, files, or links sent to you through ProTalkie)

  • Accounts that repeatedly infringe copyright

✘ We CANNOT remove:

  • Encrypted messages stored on our servers

  • Encrypted voice notes, images, videos, files

  • Content we cannot decrypt or access

If the content exists only inside an E2EE chat, we cannot access or delete it — but we can take action against the user/account.

3. How to File a DMCA Takedown Notice

If your copyrighted work was shared on ProTalkie without permission, you may submit a takedown request.

Your notice must include all items required under DMCA § 512(c)(3):

Required Information

  1. Your full name, address, phone number, and email

  2. Identification of the copyrighted work you claim was infringed

  3. Evidence of ownership (links, documents, registration certificates, etc.)

  4. A description of the infringing material including screenshots or copies, since we cannot access message content

  5. The phone number of the ProTalkie user who shared the infringing content

  6. A good-faith statement that you believe use of the material is unauthorized

  7. A statement that all information in your notice is accurate

  8. A statement, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf

  9. Your physical or electronic signature

We will confirm receipt within a reasonable time.

4. What Happens After We Receive a Notice

Once we receive a valid DMCA notice:

  1. We verify that the notice meets legal requirements

  2. We review the evidence provided

  3. We notify the user (unless prohibited by law)

  4. We may:

    • Warn the user

    • Remove any unencrypted material you provided

    • Restrict or suspend the user

    • Terminate accounts of repeat infringers

If the content exists solely in end-to-end encrypted messages, we cannot access or remove that content. However, we will still take appropriate action against the user.

5. Counter-Notification Instructions

If you believe a DMCA notice was submitted in error, you may file a DMCA counter-notice.

Your counter-notice must include:

  1. Your name, address, phone number, and email

  2. Identification of the material removed or the action taken

  3. A statement under penalty of perjury that the removal was a mistake or misidentification

  4. Your consent to the jurisdiction of courts in:

    • Your region, or

    • Gurgaon, India (if outside the U.S.)

  5. Your electronic or physical signature

If valid, we will review the counter-notice and may restore the content (only if we have a copy — which generally we do not, due to encryption).

6. Repeat Infringer Policy

In accordance with DMCA safe-harbor rules:

  • We may terminate accounts of users who repeatedly infringe copyrights

  • We may restrict users who repeatedly receive valid copyright complaints

  • Decisions are final at ProTalkie’s discretion

We record infringer histories without revealing user content.

7. False or Fraudulent Claims

Submitting false DMCA notices or counter-notices is illegal and may result in:

  • Account termination

  • Legal liability for damages

  • Reporting to authorities

  • Civil penalties under 17 U.S.C. § 512(f)

Please submit DMCA claims responsibly.

9. Changes to This Policy

We may update this DMCA Takedown Policy periodically.
Updates will be posted with a new “Last Updated” date.
