Terms of Use (EULA)

These Terms of Use (“Terms”) govern your use of ProTalkie (“the App”), provided by PPLST Tech Private Limited (“we,” “our,” or “us”).
By downloading, accessing, or using ProTalkie, you agree to be bound by these Terms.
If you do not agree, do not use the App.

1. Eligibility

You must meet the following age requirements to use ProTalkie:

13+ worldwide
16+ in the EU/UK, unless parental consent is provided

By using ProTalkie, you represent that you meet the required age.

2. License to Use ProTalkie

We grant you a limited, revocable, non-exclusive, non-transferable license to install and use ProTalkie for personal, non-commercial communication, subject to these Terms.

You agree not to:

Copy, modify, reverse-engineer, or decompile the App
Resell, rent, or distribute the App
Bypass or interfere with any security controls

All rights not expressly granted remain with PPLST Tech Private Limited.

3. Your Responsibilities

By using ProTalkie, you agree to:

3.1 Use ProTalkie lawfully

Do not use the App for illegal, harmful, abusive, or fraudulent activity
Do not engage in harassment, threats, impersonation, or hate speech
Do not upload or send content that violates laws or rights (copyright, trademarks, privacy, etc.)

3.2 Respect others’ rights

You are responsible for the content you send.
You must have the rights or permissions to share any media, files, or recordings you send.

3.3 Maintain device & account security

You are responsible for maintaining the security of your device and account credentials.

4. End-to-End Encryption & Communication Disclaimer

ProTalkie uses end-to-end encryption to protect message content.

This means:

We cannot access or read your messages
Only you and your recipients can decrypt message content
Message metadata (timestamps, file size, device info) may be stored
Not an emergency service

You acknowledge that:

ProTalkie does not guarantee message delivery
Talkies may be delayed or fail due to network or device conditions
The App must not be used for emergency or life-critical communications
We are not responsible for losses or harm caused by delayed or undelivered messages.

5. User Content & License

You retain ownership of the content you send using ProTalkie.

By using the App, you grant us a limited, worldwide, non-exclusive, royalty-free license to:

Transmit your content to intended recipients
Store encrypted copies until you delete them
Process and manage your content solely to operate the App
We do not access or use your content for advertising or analytics.

6. Prohibited Conduct

You agree not to use ProTalkie for:

Illegal activity or criminal purposes
Sending malware, viruses, or harmful files
Harassing, bullying, or abusing others
Violating intellectual property rights
Child exploitation or other prohibited content
Spamming or automated messaging
Attempting to bypass encryption or security systems

Violation may lead to account suspension or termination.

7. Intellectual Property Rights

ProTalkie, its logo, UI designs, software, features, and branding are the property of PPLST Tech Private Limited.

You may not:

Copy or reproduce any part of the App
Use our trademarks without permission
Create derivative works based on the App
Report IP concerns to: admin@pplsttech.com

8. Safety, Misuse & Reporting

We provide tools to block users and control your privacy.

If you experience abuse or illegal activity, you can report it via:
admin@pplsttech.com

We may, where legally required, cooperate with law enforcement regarding serious misuse. We cannot decrypt message content but may share available metadata.

9. Data & Privacy

Our Privacy Policy explains how we collect, use, store, and protect personal data. By using the App, you agree to our Privacy Policy.

10. Account Suspension or Termination

We may suspend or terminate your access if you:

Violate these Terms
Misuse ProTalkie
Harm other users or the platform
Engage in unlawful or abusive behavior

Upon termination:

Your license ends immediately
Your data will be deleted in accordance with our Privacy Policy
You may delete your account at any time from the App.

11. Updates & Changes

We may update ProTalkie or these Terms from time to time.

Continued use after changes means acceptance. Significant changes may be communicated in-app or on our website

12. Third-Party Services

ProTalkie uses trusted partners such as:

Firebase (analytics, authentication, crash reports)
AWS S3
APNS/FCM (push notifications)

These services operate under their own privacy and security standards.

13. Export Control & Sanctions Compliance

You agree not to use the App if you are:

Located in a country sanctioned by the UN, US, or EU
On any government-restricted parties list

You must comply with all applicable export control laws.

14. Disclaimers

ProTalkie is provided “as is” and “as available,” without warranties of any kind.

We disclaim all implied warranties, including:

Fitness for a particular purpose
Reliability
Availability
Non-infringement

We do not guarantee:

That messages will always be delivered
No loss, corruption, or delay of messages
No downtime or interruption

15. Limitation of Liability

To the maximum extent permitted by law:

PPLST Tech Private Limited is not liable for:

Loss of data
Missed or delayed communications
Loss of profits, revenue, or opportunities
Damages from using or being unable to use the App
Harassment or harm caused by other users
Issues arising from device or network failure
Your sole remedy is to stop using ProTalkie.

16. Indemnification

You agree to indemnify and hold harmless PPLST Tech Private Limited from claims, damages, losses, or liabilities arising from:

Your content
Your misuse of the App
Your violation of these Terms or any laws

17. Governing Law

These Terms are governed by the laws of India, with jurisdiction in the courts of Gurgaon, Haryana, India.

Users in other countries retain any non-waivable consumer rights under their local laws.
